In consideration of my/our registration for use and/or license of services through Manor Mill, and my entry onto and use of the facilities, located at 2019 and 2029 Monkton Road (the “Property”) I hereby freely and voluntarily agreed to the following representations, waivers, covenants and agreements: 

I the undersigned, freely acknowledge and realize the dangers of entering onto and participating in activities, workshops, performances, classes and lessons and use of related and necessary tools and equipment and facilities (collectively the “Activities”) located at  the Property managed by Monkton Trade & Craft, LLC (the “Manager”) and fully assume all risks including but not limited to personal injury, accidents, the negligence of other persons, sponsors, or promoters, and dangers arising from falls, hidden dangers, equipment failure, inadequate safety equipment, inadequate supervision or instruction, weather conditions, as well as the possibility of physical and/or mental trauma (or injury). 

I realize that the Activities may require physical conditioning and I represent that I am in sound physical condition, have adequate experience and capable of participating without risk to myself or others.  I understand and agree that a situation or a combination of conditions and independent risks may arise which may be beyond the control of the Manager or their agents or invitees which may cause injury, including severe or fatal injuries to myself and others.

I agree that I alone am responsible for my proper preparation and safety while engaging in the Activities; and the preparation and safety of minors over whom I have control and/or supervision at the Property. I have no physical or mental condition that would endanger me or others while I am engaging in the Activities. I further agree and understand that the Manager and/or owner of the Property may implement and enforce rules and regulations with which I agree to be familiar and bound.

I waive, release, indemnify and discharge for myself, my heirs, executors, administrators, guardians, and legal representatives (including successors), any and all rights and/or claims which I have, may have, or which may hereafter accrue to me against the Manager or any lessee or owner of all or any portion of the Property where I will be during the Activities, and all other individuals, promoters, sponsors, and affiliated organizations and their respective agents, support personnel, volunteers, representatives, officers and employees for any damages, injuries or claims which may be sustained by me directly or indirectly arising out of my participation in the Activities whether caused by the negligence of those related above or otherwise, and whether or not such injury was foreseeable, including all such claims regarding the design, maintenance, or condition of any structure, equipment, or device at the Property, or its facilities without regard to whether such equipment or device is specified or recommended by such Manager, and without regard to whether such Manager is properly charged with the maintenance of the Property or any of its facilities.  My waiver and release of all claims, demands, actions and liability shall include without limitation, any injury, damage, or loss to my person or property which may be: (a) caused by any act, or failure to act, by the above-identified persons and entities; (b) sustained by me before, during or after the Activities and its related events; or (c) incurred by me as a result of or in connection with medical treatment necessitated by the foregoing. I/We hereby acknowledge that my participation in the Activities is at my own risk and that the manager or any lessee or owner of all or a portion of the Property, including their respective officers, directors, owners, employees, agents or any other affiliated individuals and/or entities are in any way responsible for my safety while at the Property.

The above agreements and representations are my express understandings of the risks and I assume these voluntarily and freely without coercion or duress.  This Agreement may not be modified orally and may not be waived in any respect.  I accept responsibility for the condition and adequacy of the Property, any device or apparatus, I may use, safety gear and other equipment, and agree to abide by all rules encountered during the Activities including the recommended wearing of protective clothing, safety devices, and other gear, as well as other requirements of the Manager.

I also consent to and permit emergency medical treatment in the event of injury or illness.

I also acknowledge that if I cancel within 48 hours of the event I will not be refunded for the cost of any tickets to the event.

I have read this Agreement, Waiver, and Release and intend that same be executed under seal as defined by the laws of the State of Maryland if any term or provision of this agreement is found invalid or unenforceable, the remaining terms and provisions of this agreement shall remain binding and enforceable.
